The two exceptions are John Durham, who is the special counsel investigating the Russia-collusion investigation, and the US Attorney for Delaware, who is investigating Hunter Biden's tax issues.

The Biden administration is preparing to ask 54 of 56 US attorneys appointed by former President Trump to resign. The two exceptions are John Durham, who is the special counsel investigating the Russia-collusion investigation, and the US Attorney for Delaware, who is investigating Hunter Biden's tax issues.

The Department of Justice will ask for the resignations of the remaining 54 attorneys as early as Tuesday. It is not uncommon for new administrations to ask for resignations, Trump did this with Obama's US Attorney's as well.

In 2017, Attorney-General Jeff Sessions asked 46 US attorneys appointed by President Barack Obama to resign.

As reported by CNN, acting Attorney General Monty Wilkinson in a call on Monday night asked David Weiss, US attorney for Delaware, to remain in office. David Weiss is currently overseeing the tax investigation into President Joe Biden’s son, Hunter Biden.

Wilkinson also asked Connecticut US Attorney, John Durham, to continue his work on the special counsel investigating into the origins of the Trump-Russia probe. Durham is expected to resign shortly after.

President Biden nominated federal appeals court Judge Merrick Garland for US Attorney-General, though he has yet to be confirmed by the Senate.
