John Anthony Schubert III has been sentenced to 18 months in prison followed by 24 months of supervised release.
A Florida man who pleaded guilty to assaulting law enforcement officers during the events of January 6 and was sentenced to prison on Thursday. John Anthony Schubert III, 47, was sentenced to 18 months in prison followed by 24 months of supervised release.
In addition to the time in prison, Schubert was also ordered to pay $2,000 in restitution. He pleaded guilty to a single felony count of assaulting, resisting, or impeding certain officers. He was arrested in October 2023, by the FBI in Bradenton, Florida.
According to a Department of Justice press release, Schubert was part of a crowd that breached police barricades and went to the West Plaza of the Capitol on January 6. Schubert engaged in a physical altercation with law enforcement, during which he "put his left shoulder and arm on an officer" and pushed the officer with his weight. Schubert also attempted to punch an officer but retreated after being sprayed with a chemical irritant.
Court documents also revealed that Schubert entered the Capitol by climbing into a broken window near the Senate Wing Door. After entering the building, he assisted his parents in climbing into the same window.
Since January 6, 2021, over 1,470 individuals from nearly every state have been charged for actions related to the events of that day, with more than 530 of these individuals charged with assaulting or impeding law enforcement officers. However, the Supreme Court ruled last month that the DOJ had incorrectly charged hundreds of defendants with obstructing an official proceeding. Approximately 350 individuals at the Capitol on January 6 were charged under the obstruction law.
