The Department of Homeland Security (DHS) announced that US Immigration and Customs Enforcement (ICE) has requested that New York authorities not release Bairon Posada-Hernandez, a Honduran illegal immigrant who has been deported four times with an extensive criminal record, who is now accused of shoving two men onto New York City subway tracks.

The alleged attack occurred on Sunday, March 8 at the Lexington Avenue-63rd Street station in Manhattan. According to officials, a 30-year-old victim is in stable condition, while an 83-year-old Air Force veteran remains in critical condition. Posada-Hernandez was arrested on March 10 and charged with attempted murder. ICE placed an immigration detainer on him the same day, requesting that local authorities notify the agency before releasing him so he can be taken into federal custody. 

“Bairon Posada-Herandez is a serial criminal and four-time deported illegal alien from Honduras who should never have been able to walk our streets and harm innocent Americans,” said DHS Deputy Assistant Secretary Lauren Bis. “We are praying for the victims and their families. DHS is calling upon New York sanctuary politicians to commit to this ICE detainer and not release this heinous criminal back into New York communities.”

According to DHS, Posada-Hernandez first entered the United States illegally on January 2, 2008. He has been deported four separate times, most recently in 2020. Officials say he reentered the United States illegally a fifth time at an unknown date and location. The suspect also has a lengthy criminal history, with 15 prior charges including simple assault, domestic violence, obstruction of police, possession of a weapon, drug possession, and aggravated assault.

The announcement comes as DHS continues to criticize New York’s sanctuary policies. In February, the department condemned New York City Mayor Zohran Mamdani after he signed an executive order that DHS said effectively shields violent criminal illegal immigrants from federal immigration enforcement. Mamdani’s order came just one week after New York Gov. Kathy Hochul proposed legislation that would bar local police departments from partnering or cooperating with ICE.

According to DHS data, more than 7,110 illegal immigrants in custody across New York had active ICE detainers as of February. The crimes tied to those individuals include 148 homicides, 717 assaults, 134 burglaries, 106 robberies, 235 dangerous drug offenses, 152 weapons offenses, and 260 sexual predatory offenses.
