US District Judge Aileen M. Cannon announced on September 5 that she would appoint a special master to independently review the documents the FBI took from Trump's Mar-a-Lago estate.
On Thursday, she did just that, rejecting the Biden administration’s request for a partial stay and appointing Judge Raymond Dearie as special master.
“The Court does not find it appropriate to accept the Government’s conclusions on these important and disputed issues without further review by a neutral third party in an expedited and orderly fashion,” Cannon wrote in her ruling, urging Dearie to complete his review by November 30.
The DOJ had originally asked that the special master conclude by October 17, prior to the midterm elections.
The request to appoint a special master was made in a lawsuit filed by former President Donald Trump in an effort to ensure that only legally necessary materials from the Mar-a-Lago raid can be used against him in the investigation.
Dearie’s job will be to comb through everything that was seized and suss out what is and is not admissible.
While the majority of Cannon’s ruling was favorable to Trump, she did order that he pay for Dearie’s time, and any additional staff he may require along the way.
FOX News’ Jesse Watters called the ruling a “big blow to the Department of Justice,” since the documents will be off-limits to them while Dearie conducts his review.
As Cannon pointed out in her ruling, however, “questioning witnesses and obtaining other information about the movement and storage of seized materials, including documents marked as classified” is permitted, “without discussion of their contents.”
