The House Committee on the Judiciary on Monday filed a lawsuit against Attorney General Merrick Garland to obtain the audio tapes of Biden’s interview with special counsel Robert Hur in the classified documents investigation. This comes as the House is set to vote on holding Garland in inherent contempt in the upcoming session.
The lawsuit, filed in the US District Court for the District of Columbia, stated that the subpoena issued for Garland is "required, and still requires, Defendant Garland to produce the documents and records as set forth in Schedule A of the Subpoena, including the audio recordings of the Special Counsel’s interviews with President Biden and Mark Zwonitzer."
"The Judiciary Committee has attempted to make reasonable accommodations for Garland’s production, including by agreeing to review two documents in camera and extending the return date of the Subpoena three times, but those efforts are at an impasse, and Garland continues to refuse to produce the audio recordings of the Special Counsel’s interviews with President Biden and Mark Zwonitzer."
"There is no lawful basis for Garland’s refusal to produce to the Committee the audio recordings of the Special Counsel’s interviews with President Biden and Mark Zwonitzer."
"Garland violated, and continues to violate, his legal obligation by refusing to produce to the Committee the audio recordings of the Special Counsel’s interviews with President Biden and Mark Zwonitzer when those recordings are not covered by executive privilege, and, even if they were, executive privilege has been waived,” the lawsuit added.
The lawsuit stated that the Judiciary Committee has been and continues to be "injured by Garland’s refusal to produce the audio recordings."
The committee asks that the court order Garland to hand over the audio recordings.
Garland refused to hand over the subpoenaed recordings and was held in contempt of Congress. The Department of Justice refused to prosecute Garland.
