The 54-year-old Biden faces a maximum sentence of 25 years in prison, though Judge Maryellen Noreika has yet to set a sentencing date.
On Monday, attorneys for Hunter Biden requested a new trial following the president’s son’s conviction in his federal gun case, but minutes later removed the request.
The court papers filed in Delaware federal court Monday morning stated that Hunter Biden should be granted a new trial on jurisdiction grounds because there are two appeals still pending, according to the New York Post.
"The Third Circuit [appeals court], however, did not then and has not yet issued its mandate as to the orders dismissing either appeal. Thus, when this Court empaneled the jury on June 3, 2024, and proceeded to trial, it was without jurisdiction to do so," Abbe Lowell wrote.
Not long after the motion was filed, however, the motion appeared to have been rescinded.
“The Motion for a New Trial… has been deleted at the request of counsel,” a court docket note stated.
On June 11, Hunter Biden was found guilty on all counts in his federal gun case. He was charged with making false statements while purchasing a firearm, making false statements regarding information kept by federal firearms licensed dealers, and unlawful possession of a firearm. The charges stemmed from Biden's alleged drug use at the time of purchasing the firearm and lying about this drug usage on federal firearm purchase forms. Federal law prohibits users of illicit drugs from possessing firearms.
