WATCH: Tucker Carlson slams policies housing biological males in women’s prisons as ‘cruel and unusual’ punishment

"Authorities say Chan was having sex with his 79-year-old mother who has dementia," said Carlson, noting that Chan was charged with incest.

The Virginia Criminal Code classifies "adultery and fornications by persons forbidden to marry; incest" as a Class 5 felony, punishable by up to 12 months in jail and/or a $2,500 fine, he said.

"Chris Chan is a biological man, but he identifies as a woman," Carlson said. "Reportedly, Virginian authorities went along with that. They classified Chris Chan as a female, and that means Chris Chan, who is an accused sex criminal, would be housed in a women's jail."

39-year-old Christine Weston Chandler, aka "Chris Chan" aka "Sonichu" aka Christian Weston Chandler, the transgender webcomic creator and living Internet meme, was arrested, handcuffed and taken into custody by Greene County Police on Sunday.

Chandler's arrest was prompted by the leak of audio and chat logs, which revealed disturbing details about elder abuse and his performance of alleged non-consensual sexual acts, or rape, of his 80-year-old disabled mother, whom he referred to as a "love quest."

As the story began trending on Twitter, several users leapt into the conversation, imploring that everyone "respects her pronouns."

Tucker said the authorities backtracked on their decision to house Chan in a women's prison, "likely due to public pressure." He added: "But this is not an isolated incident. Many prisons in this country house biological men with women."

Kara Dansky, president of the US Chapter of the Women's Human Rights Campaign, who predicted this would be reality.

"We know for a fact that California passed SB 132 last year. It went into effect in January of this year," she said, adding that some 300 male prisoners sent applications to be housed in a women's prison in California. "We approximate that 20 of them have been granted."

SB 132 is a law that requires the California Department of Corrections and Rehabilitation (CDCR) to record an inmate's self-reported gender identity, gender pronouns and titles throughout their term in the facility. It also permits inmates who identify as transgender to request to be transferred to a facility that aligns with their gender identity as opposed to their biological sex.

"We suspect that none of these applications have been denied," said Dansky.

Since the new law came into effect in January 2021, all but six of the 261 have requested a transfer to a women's prison, as opposed to the reverse. Only one percent of California's prison population — or 1,129 inmates — identified as nonbinary, intersex or transgender, according to the corrections department, populations that experience excessive violence in prison, according to Dansky.

"We also know in Washington state that approximately nine male felons are being housed in a women's prison," said Dansky. "One has been convicted of multiple murders of women, and another one of those men was convicted of raping a 12-year-old girl." Another is a notorious baby-killer who is now housed in the same prison with the mother of the baby the inmate murdered.

Dansky added that states across the country have statutory laws that allow for the housing of biological men in women's prisons.

Tucker replied "I'm not in the habit of carrying the banner for prison inmates, but this is cruel and unusual. If you are convicted as a woman, you have an expectation that you're not going to be raped in jail. Has anyone brought this to court? It's so over the top and outrageous."

"Yes, these women are being held under torturous conditions, with some reporting they are absolutely terrified," Dansky confirmed. "It has also been preliminarily reported that one woman in a California prison has been impregnated and that the California Department of Corrections and Rehabilitation is distributing condoms."

She said this is telling of California prison officials, who "understand and anticipate these men will be raping these women."

"They also understand that these people being transferred to women's prisons are not women. They are men."

"Sure, if everyone in the prison were female, you probably wouldn't be distributing condoms at taxpayer expense," said Tucker.

"This should be obvious to everyone, but the problem is that most people in America have no idea this is going on," replied Dansky, who said this could "absolutely go to court" because it is "in blatant violation of international norms that require the separation of prisoners by sex."

She noted that most women in prison have not committed a violent offense and tend to be housed under less strict security conditions than men.

Dansky concluded that this means men transferred to women's prisons will observe security synonymous with women's prisons or that women's prisons will have heightened security.
