Sofia Quintanar, 33, is accusing the Attorney General's office of covering up the allegations and of making "misleading statements to the press" regarding the investigation into multiple sexual harassment claims, according to the New York Post.
It is alleged that during a political fundraiser in Brooklyn last year, Khan forcefully shoved his tongue down Quintanar's throat after coaxing her outside and away from the crowd.
The complaints and subsequent investigation were allegedly kept quiet until after James' election day victory so as not to affect her campaign.
Khan was then given the opportunity to resign from his position on November 22, more than a week before the conclusion of the investigation, with pay until the end of the year.
He had been previously suspended for two months pending an investigation into the multiple claims, a fact that was covered up by the AG's office.
The investigation concluded on December 2 that Khan had sexually harassed two former staffers.
The lawsuit claims that Quintanar had to learn "from press reports that Attorney General James permitted Khan to resign without formally revealing the reasons for his departure."
The suit also claims that a press office deputy was allowed to resign in 2019 "under similar circumstances."
She is suing for unspecified damages, citing claims against James, her office, and her campaign including negligence, discrimination, and retaliation.
Quintanar worked for James' office through 2020, then left to work on Buffalo Mayor Byron Brown's re-election campaign in 2021.
Once he was successfully re-elected, her subsequent job hunt led her to attend the fundraiser in Brooklyn at which the assault took place.
The suit states that Khan coerced her into going outside, claiming that the venue was too loud. Once outside and away from the crowd, he allegedly "rested the weight of his hand on Quintanar’s shoulder, and shoved his face forward aggressively to kiss her, without saying a word," before sticking his tongue down her throat.
He allegedly tried to kiss her again even after she pushed him away, then continued to follow her as she went back inside.
She didn't come until almost a year later, as she was afraid her career would suffer due to "Khan's high profile and his power within New York Democratic politics."
