Tim Pool and Jack Posobiec break down Binger’s case against Dominick Black

On the most recent episode of Timcast IRL, Tim Pool and guests Jack Posobiec and attorney Andrew F. Branca analyzed the case against Dominick Black.
With the trial of Kyle Rittenhouse over, many have shifted their attention to the trial of Dominick Black, the now 20-year-old friend who bought then 17-year-old Rittenhouse the gun used in Kenosha. Following the incident, Black was charged with two counts of providing a firearm to a minor, resulting in death.
Despite the not-guilty verdict handed down to Rittenhouse, and the dismissal of gun charges against him, the case against Black remains open, with a new hearing date set for January 2022.
"He's going for Dominick Black on the gun charges," Pool said of prosecutor Thomas Binger, "but I think he's desperately trying to get back at Rittenhouse."
"The gun charge is not coming back on Kyle," Branca replied. "Basically the judge ruled that as a matter of law it doesn't apply. The statute they charged Kyle with simply is inapplicable to [Black's] circumstances ... so the fact that Kyle's was dismissed has nothing to do with Black's."
In Black's case, "the statute is a gun that was used in a death," Posobiec pointed out.
Branca went on to say that the statute in question, "giving a gun to a minor and a death results," is "intended, of course, to prevent giving guns to young gang members who then go kill people or get killed themselves."
"In those cases what the statute's intended to prevent is unlawful deaths, and that didn't happen here," he concluded. "This gun was used in a justified manor. These deaths were lawful, determined in a court of law. So I would argue that this statute does not apply to the specific circumstances of Dominick Black because the gun he provided was not used to commit an unlawful killing."
