Texas AG files suit against Biden over 'asylum' app for illegal immigrants

"The Biden Administration’s reckless and unlawful open border policies are overwhelming Texas’s border communities."

On Tuesday, Attorney General Ken Paxton filed a lawsuit against the Biden administration in an attempt to fight their "unlawful open borders policies." The suit is about the Department of Homeland Security pre-approving migrants through an app.

According to Breitbart, any foreigner seeking asylum in the United States is required to apply for protection in a third country prior to arriving. The Customs and Border Protection (CBP) allows migrants to apply on their mobile app up to 14 days beforehand.

Paxton claimed the administration "deliberately conceived this phone app with the goal of illegally pre-approving more foreign aliens to enter the country and go where they please once they arrive.”

"Joe Biden, Alejandro Mayorkas, and the entire Biden Administration have prioritized creating and protecting new ways for illegal aliens to stream into this country, no matter the cost or consequence to struggling American citizens," he alleged. "Time after time, my office has shown that we will fight back in court to defeat their unlawful open-borders policies. We intend to stop this rule from wreaking further havoc on the people of Texas."

The lawsuit said the app “works in conjunction with the Administration’s expanded parole policies and processes to expedite and streamline the processing of aliens at the border and move them into the country more quickly."

"The Biden Administration’s reckless and unlawful open border policies are overwhelming Texas’s border communities," it continued, "Through the CBP One app, the Biden Administration is inviting illegal aliens to cross the border at five ports of entry in the State of Texas: Brownsville, El Paso, Eagle Pass, Hidalgo, and Laredo."

"By inviting illegal aliens into Texas, Defendants will inflict costs on the State for public education, law enforcement and incarceration, unreimbursed health care, and other public services for illegal aliens," noted the suit.

A spokesperson for the Department of Homeland Security defended the app and said, “Lawful pathways like making an appointment to appear at a port of entry using the CBP One app allow us to process migrants in a safe, orderly, and humane way and reduce unlawful immigration."

"This is particularly critical at a time when Congress has failed to reform our broken immigration system," added the spokesperson.

After Title 42 orders expired earlier this month, the Biden administration noted that it expects the crisis at the southern border to worsen before it gets better. Over 60,000 asylum-seekers have utilized the App to enter the US since being implemented in January, per CBS.
