"These three rulings are all victories for the rule of law and common sense," DHS General Counsel James Percival said.
These rulings, DHS explained, show that "activist judges" have failed to thwart President Trump's nationwide crackdown on illegal immigration.
"These three rulings are all victories for the rule of law and common sense," DHS General Counsel James Percival said. "This includes barring aliens from applying for asylum if they haven't set foot in the United States, making it easier to remove lawful permanent residents (LPRs) who commit a crime, and reaffirming that Temporary Protected Status (TPS) was always supposed to be temporary and can be cancelled at the appropriate time."
Supreme Court Justices rendered a 6-3 vote on all three decisions.
In Mullin v. Al Otro Lado, SCOTUS ruled that a foreign national standing at the border in Mexico is not entitled to asylum by simply claiming it, nor is an immigration officer required to inspect them for asylum. This decision reverses a Ninth Circuit Court of Appeals opinion that declared foreign nationals outside the United States' borders are eligible for asylum. A foreign national is only to be considered for asylum once they have successfully arrived in the United States, per the ruling.
SCOTUS decided in Blanche v. Muk Choi Lau that a criminal Lawful Permanent Resident (LPR), also known as a green card holder, is not awarded removal protections. US Customs and Border Protection (CBP) does not have to have clear and convincing evidence that an LPR committed a crime involving "moral turpitude" before deferring them for inspection. Their conviction can now be used as a justification for removal, said DHS.
Lastly, in Mullin v. Doe, SCOTUS ruled that the Trump administration can cancel Temporary Protected Status (TPS) for Haitian and Syrian migrants, affirming that temporary status does, in fact, mean temporary.
Percival said each decision was a "big win," saying that SCOTUS has granted the agency "several more important tools to continue securing our borders."
Additionally, DHS said that under the leadership of President Trump and Secretary Mullin, the agency "will continue to uphold the law and keep the American people safe."
