"I am giving you one last chance to stay out of state prison."
On Friday, San Fransisco man Daniel Caulch was sentenced to just five years probation and a supervision program after being convicted of violently stabbing 94-year-old Chinese and Vietnamese immigrant Anh 'Peng' Taylor in June 2021.
During the sentencing hearing, Judge Kay Tsenin told Caulch, "I am giving you one last chance to stay out of state prison."
According to the Daily Mail, instead of sending the criminal to state prison, Cauich was enrolled in an Intensive Supervision Court program for high-risk probationers.
In reaction to the sentence, Assistant District Attorney Phoebe Maffei said, "[The stabbing] was senseless and horrifying and suggests a quick willingness to harm vulnerable people within our community." She noted that he should serve 12 years in prison.
Despite Cauich's history of criminal conduct, defense attorney Lisa DewBerry successfully used a neuropsychology report to show underlying trauma and brain injuries that caused him to commit the assault.
"When we were able to get through to him to tell him what he had done, the man cried," DewBerry said. "he couldn't believe he did such a thing to her."
Taylor's family said, "She is well-recovered and doing fine now." Her Daughter Vivianne noted, "After the attack, we moved her to an assisted living home."
At the time of the incident, Cauich had only been out of jail for nine days and was wearing an ankle monitor, the New York Post reported at the time. He was charged with attempted homicide, battery with serious injury, elder abuse, committing a felony while on bail OR release, great bodily injury enhancement, and probation violation.
Before the attack, Cauich was convicted of multiple burglary charges and had spent over 100 days in jail. In another incident, Cauich was charged in the fatal stabbing of a 55-year-old man, but the case was dismissed due to lack of evidence.
