"Based on testimony today, I have enough evidence to believe both Tim Walz and Keith Ellison were knowingly complicit in a Somali fraud scheme in Minnesota," Luna wrote. "Therefore I have referred them BOTH to the DOJ for criminal charges. May justice be swift. The American people are tired of being taken advantage of."
During the hearing, Luna questioned GOP Minnesota state Rep. Kristin Robbins about when Walz first became aware of widespread fraud in the state’s social programs. Robbins replied, "I would assume that he has been aware of it since he ran for office for governor in 2018."
Robbins confirmed that warnings from DHS investigators who said that Child Care Assistance Program (CCAP) fraud could exceed 50 percent had been elected to the governor’s office. She also confirmed that payments to Feeding Our Future, the nonprofit in which dozens of organizers have been charged and or/convicted of fraud, continued to Walz’s knowledge, despite state officials knowing by 2020 that the group’s invoices were fraudulent.
Luna said during the hearing that she would be making criminal referrals regarding Walz and Ellison. "As you know US Code 371, and US Code 2 which deals with criminalized conspiracies to defraud the United States and establishes liability for individuals who knowingly aid or abet the commission of a federal offense, includes willing full blindness or deliberate inaction or duties to act exists, so I will be referring them later on today."
A separate hearing is set to take place on February 10, in which Committee Chair James Comer has invited Walz and Ellison to testify. Luna noted during the hearing that a subpoena would likely be coming for Ellison from the committee.
