177 GOP members of Congress have signed onto an amicus brief in support of Donald Trump as the Colorado case to keep him off the ballot will be argued before the Supreme Court in February.

The brief argues that the Colorado Supreme Court’s ruling, which took Trump off the ballot in the state under the 14th Amendment, had a view of the amendment that is ''too expansive" and "encroaches" on congressional authority, according to The Messenger.
"The Colorado Supreme Court’s decision severely intrudes on those congressional powers first by allowing enforcement of Section 3 without congressional authorization, and then by concluding that Section 3 authorizes a state to de-ballot a candidate," the brief reads. Section 3 refers to the 14th Amendment’s insurrection clause.
The lawmakers stated in the brief that Congress can enforce Section 3 if a person is determined to be unqualified, but that the section does not give individual states the right to remove someone from a ballot.
