A federal appeals court this week agreed that President Donald Trump can continue delaying payment of writer E. Jean Carroll’s $83.3 million defamation judgment while the US Supreme Court decides whether it will take up the case.
The decision was issued Monday by the US Court of Appeals for the Second Circuit, which approved a continued stay on payment as Trump pursues further appeals, reports The Hill. Carroll did not oppose the delay on the condition that Trump increase his bond to account for additional post-judgment interest if his appeal is unsuccessful.
Under the court’s order, Trump must add approximately $7.46 million to the bond he had already posted, bringing the total to nearly $100 million.
“We are pleased that the Second Circuit conditioned the stay on President Trump posting a bond of nearly $100 million — increasing the $91,630,000 bond he originally posted by another $7,462,492.74 to account for the accruing post-judgment interest,” Carroll attorney Roberta Kaplan said in a statement.
The case stems from Carroll’s second civil trial against Trump.
A jury awarded Carroll $83.3 million after finding Trump defamed her by denying allegations she made regarding an alleged sexual assault in a Manhattan department store in the mid-1990s. Trump has denied the accusations.
Trump is now asking the Supreme Court to review the case after the full Second Circuit rejected his presidential immunity arguments and other attempts to overturn the judgment late last month.
He has argued that because the statements at issue were made while he was serving as president, he should be shielded by presidential immunity.
Trump has also argued that the federal government should be substituted as defendant and assume responsibility for any damages.
Carroll previously sued Trump in a separate case, where a jury found him liable for sexually abusing her and defaming her in a 2022 statement. In that case, Trump was ordered to pay $5 million.
