US District Judge Brian Murphy's ruling comes after the Supreme Court in June ruled 6-3 for the administration ending TPS for Haitians and Syrians.
A federal judge in Massachusetts on Tuesday allowed the Trump administration to end Temporary Protected Status for Ethiopians residing in the United States. US District Judge Brian Murphy's ruling comes after the Supreme Court in June ruled 6-3 for the administration ending TPS for Haitians and Syrians.
Ethiopians in the US had been granted TPS in 2022 under the Biden administration. Then-DHS Secretary Kristi Noem announced in December that TPS status for that group would be coming to an end, arguing that the protections under the status were no longer needed as conditions no longer posed a serious threat to Ethiopians returning to their country safely.
In April, Murphy had blocked the move, saying that the DHS had disregarded statutory procedures and provided a “pretextual” rationale for ending it. Following the Supreme Court’s ruling, Murphy issued a new order that temporarily blocked the end of TPS for Ethiopians as he weighed the case further. His Tuesday order lifted that stay, clearing the way for the Trump administration to end TPS for Ethiopians.
DHS General Counsel James Percival said following the Tuesday ruling, “Judge Brian Murphy just lifted the stay of Ethiopia TPS termination. All TPS terminations are in effect!”
This comes after a federal judge on Friday cleared the way for the Trump administration to end TPS for Somalis. US District Judge Allison cited the June Supreme Court ruling that limited judicial review of certain decisions concerning TPS designations.
