The ruling was from the Clinton-appointed Judge Fred Biery.
Last week, after ICE agents were in a targeted pursuit to arrest his father, Liam Ramos was taken with Conejo Arias to an immigration detention facility. According to DHS, when officers took the boy to his mother, she would not take custody of the child.
The ruling from the Clinton-appointed Judge Fred Biery stated in part, “Observing human behavior confirms that for some among us, the perfidious lust for unbridled power and the imposition of cruelty in its quest know no bounds and are bereft of human decency. And the rule of law be damned. Ultimately, Petitioners may, because of the arcane United States immigration system, return to their home country, involuntarily or by self-deportation. But that result should occur through a more orderly and humane policy than currently in place.”
The judge included a photo of Ramos in the ruling, as well as quoted the Declaration of Independence, writing, “‘We the people’ are hearing echos of that history,” as he claimed that the Trump administration’s policies are similar to that of an authoritarian king. He pointed to Thomas Jefferson’s “grievances against a would-be authoritarian king over our nascent nation.”
Officials claimed that the 5-year-old was used as "bait" to get family members to come out of the home. DHS has said they took custody of Ramos when his father "fled on foot" and abandoned Ramos. Officials then said that Ramos' mother would not take him, leading him to be taken with his father to be put in the immigration detention center.
Judge Biery had recently liked posts on his LinkedIn page that were related to millions of people protesting against ICE policies under the Trump administration.
