The Multnomah County District Attorney’s Office has declined to charge journalist Nick Sortor after he was arrested outside a Portland, Oregon ICE facility.

A press release from the District Attorney’s Office stated, "The Multnomah County District Attorney’s Office declined to charge Nick Sortor with Disorderly Conduct for activities related to Thursday October 2. The Multnomah County District Attorney’s Office determined that the Portland Police had probable cause to arrest Mr. Sortor at the demonstration at the ICE building that night based on the information that was available to them on scene."

"The arrest followed a small but chaotic scene involving Mr. Sortor and a group of demonstrators, two of whom were identified. All three were arrested," the press release continued. "After a careful review of the investigation, including reports and video, we do not believe the crime of Disorderly Conduct can be proven against Mr. Sortor beyond a reasonable doubt. The two other individuals arrested for Disorderly Conduct October 2nd have been charged."

Sortor wrote in response to the announcement, "VICTORY: Following our demand for discovery related to the Portland Police’s coordination with Antifa, the Multnomah County DA has announced they will DECLINE to prosecute me."

Earlier on Monday, Sortor and his legal team at Angus Lee Law Firm filed a demand for discovery against the State of Oregon over his arrest. The filing demanded flight and drone surveillance video, digital communications such as instant messages between officers about the arrest, policies and procedures relating to the handling of protests outside the ICE detention facility and the arrests of Antifa, and the records of arrests for the prior 30 days from Sortor’s arrest, among other documents and information.

In the wake of Sortor’s arrest, Attorney General Pam Bondi ordered a full investigation into Sortor’s arrest, headed by Assistant Attorney General for Civil Rights Harmeet Dhillon. In her letter to Portland Police Chief Bob Day, Dhillon requested information regarding both Sortor’s arrest and the assault of Post Millennial reporter Katie Daviscourt.

Fox News’ Bill Melugin, who spoke with Sortor after his arrest, said, "He says he was getting video of protesters getting maced by federal agents, which was embarrassing video for them as they were 'crying' etc. He says they then swarmed/surrounded him, pushed him down into a flower bed, and someone threw a punch. Nick says he swung back and missed, then disengaged and walked over to a group of Portland PD."

"He says he was then shocked to be arrested by them, and he sat in the back of a police cruiser while officers figured out what to charge him with. I asked him about the female protester who was also arrested with him. He said he talked to her in the jail and she didn’t seem like she was the one who assaulted him," Melugin added.
