BREAKING: Prosecutors will refile manslaughter charges against Alec Baldwin for fatal Rust movie set shooting

Prosecutors in New Mexico are reportedly planning to refile charges against Alec Baldwin for the fatal Rust movie set shooting from 2021, charging him with involuntary manslaughter.

Two sources familiar with the matter told NBC News that Baldwin’s case will be brought before a grand jury next month, and that there have been recent discussions of a plea deal.

One of the sources said that after further investigation, prosecutors no longer believe that the gun involved had been modified, and have found new evidence that reportedly connects the star to reckless safety standards on the set.

"It is unfortunate that a terrible tragedy has been turned into this misguided prosecution," said Luke Nikas and Alex Spiro, Baldwin’s attorneys, in a statement. "We will answer any charges in court."

If convicted, Baldwin could face up to 18 months in prison.

Special prosecutor Kari Morrissey told NBC News, "We believe that based on our lengthy and detailed investigation that it is appropriate for a grand jury in New Mexico to make a decision on whether the case should proceed."

Charges were dropped by Morrissey and Jason Lewis against Baldwin earlier in the year, citing "new facts" in the case. 

They released a statement at the time saying "this decision does not absolve Mr Baldwin of criminal culpability and charges may be refiled."

On the New Mexico set of Rust in October of 2021, a revolver that Baldwin was handling fired, striking cinematographer Halyna Hutchins.

Baldwin has claimed that he didn’t pull the trigger, but an FBI analysis concluded that Baldwin pulled the trigger of the gun, with the shooting also wounding director Joel Souza.

Baldwin and Rust weapons armorer Hannah Gutierrez-Reed were both formally charged with involuntary manslaughter in January. 

While Baldwin’s charges were dropped, Gutierrez-Reed still faces charges.
