BREAKING: SCOTUS allows Trump to revoke 'temporary protected status' for migrants in 8-1 decision pending appeal

The Supreme Court on Monday allowed the Trump administration to move forward, for now, with plans to end Temporary Protected Status for migrants who came to the US under the Cubans, Haitians, Nicaraguans, and Venezuelans (CHNV) parole program.

The court lifted an injunction that had been placed on the Trump administration blocking them from ending TPS status. The ruling was an 8-1 decision.

"The application for stay presented to Justice Kagan and by her referred to the Court is granted. The March 31, 2025 order entered by the United States District Court for the Northern District of California, case No. 3:25-cv-1766, is stayed pending the disposition of the appeal in the United States Court of Appeals for the Ninth Circuit and disposition of a petition for a writ of certiorari, if such a writ is timely sought. Should certiorari be denied, this stay shall terminate automatically. In the event certiorari is granted, the stay shall terminate upon the sending down of the judgment of this court," the order stated.

The order granted an emergency application filed by the administration, allowing them to move forward with revoking the status of Venezuelan migrants after the Biden administration had extended the protections, per NBC News. 

The Biden administration had extended the status in January, shortly before the Trump administration began, which allows legal status in the US for those in the program and allows work authorization for up to 18 months. 

Department of Homeland Security Secretary Kristi Hoem sought in February to bring those protections to an end, however, California-based Judge Edward Chen blocked the move. The National TPS Alliance and individual Venezuelans had challenged the move in court.
