BREAKING: SCOTUS upholds Texas law allowing arrest of those crossing US border illegally

The Supreme Court of the United Stated has just lifted a block on Texas’ state-wide illegal immigration law. This will allow the state to begin making arrests and detaining those that have entered the state by illegally crossing the US border instead of relying on federal authorities.  



Senate Bill 4, that was signed into law by Governor Greg Abbott, will move forward after it was blocked by the court earlier. 

"Texas Senate Bill 4 (S. B. 4) permits the State to arrest and remove to Mexico noncitizens who enter, attempt to enter, or reside in Texas," the justices wrote in the ruling. 

The court ruled that the stay on SB 4, that had been extended by Justice Samuel Alito just the day before will be lifted, allowing state authorities to enforce the immigration law. 

Justices Amy Coney Barrett as well as Brett Kavanagh wrote a concurrence for the decision while the three liberal justices wrote in dissent.  


“Today, the Court invites further chaos and crisis in immigration enforcement,” Justice Sonia Sotomayor, joined by Justice Ketanji Brown Jackson, wrote in their thoughts. 

In defense of the law, Texas argued the state has a constitutional rigtht to defend itself if the Biden administration is not able to secure the border. 

“Plaintiffs urge the Court to rush straight to the merits of their claims,” the Texas said about the stay in a court filing. “But these cases do not belong in federal court at all—even apart from the fact that no state court has yet had an opportunity to construe any provision of S.B.4.”
