Bannon began serving his four-month sentence in a Connecticut federal prison on July 1.
"The Court should reimpose its order granting bail pending appeal, so Mr. Bannon is not forced to serve his entire sentence" before the full benches of the DC Circuit or Supreme Court "can hear his case on the merits," Attorneys Trent McCotter and Evan Corcoran wrote.
They also wrote that if bail isn’t approved, "Mr. Bannon respectfully requests that the Court reduce his sentence (even a few days per conviction would suffice) and impose a period of supervised release (again, even a few days per conviction would suffice) so he can be eligible to utilize First Step Act credits."
Bannon began serving his four-month sentence in a Connecticut federal prison on July 1, and is currently scheduled to be released on October 29. Bannon was convicted of contempt of Congress for defying a subpoena from the J6 Committee, after the communication being sought was deemed to be protected under executive privilege. Trump later revoked privilege so that Bannon could comply with the subpoena, but Congress, and a court, decided to go ahead with the charges.
