David Antonio Aviles Perez, 35, was taken into custody by ICE agents in San Diego in April on an international warrant that accused him of murder. He was being held by the feds in preparation for his extradition. However, before authorities could arrange that, he was released by "activist" Judge Jinsook Ohta last Wednesday. She had ordered him to be released from a California ICE facility by 5 pm the day after he was detained.
A federal official told the California Post, “Criminal aliens are being released from ICE custody by activist judges on courts across the country."
“These judges are becoming emboldened by the failure of lower-level federal prosecutors to appeal their increasingly extreme decisions due to staffing and resource constraints,” the official told the outlet. “We should all feel scandalized by that.”
Ohta's order said that the alleged murderer can only be held by federal authorities if they can prove that he is a danger to the community. Aviles Perez is wanted for murder in El Salvador in connection with a gang killing.
In addition to the warrant for his arrest internationally, Aviles Perez has been arrested for violent crimes in the US. The gangbanger was arrested by police in 2023 for assault with a deadly weapon when he allegedly swung a machete at a man in California. However, he remained at large until he was arrested by ICE in California. He was going to be extradited until he was released by the judge and is now back on the streets.
In December, El Salvador sentenced him to 20 years in prison on a charge of aggravated murder for the killing of an enemy of MS-13, according to El Salvador authorities. Aviles Perez, who is also known as "la bruja" or "the witch," shot the man dead during a dispute, per the country's attorney general.
On the day of the killing, other gang members "forced [the victim] to stop and kneel, holding him by the shoulders, while" Aviles Perez arrived with his partner in the alleged murder. They then “shot the victim in the chest, back, and face," according to the report from the authorities, who identified them as MS-13 gang members.
