DOJ charges 4 more Portland Antifa militants for criminal offenses carried out during ICE facility occupation

The Department of Justice charged four more Antifa-affiliated subjects on Monday who allegedly committed criminal acts during the ongoing Antifa occupation outside the ICE facility in South Portland. The defendants were taken into custody on a variety of charges, including assault on federal police officers, felony arson, vandalism, disobeying lawful orders, and others. This comes after nearly a month into the anti-ICE occupation, which has resulted in 17 people being federally charged.

Nadya Sofia Malinowska, 33, of Portland, born as Marek Greger Belka, has been charged with three counts of failing to obey a lawful order. According to court filings, Malinowska allegedly refused to comply with police demands to vacate federal property while protesting at the ICE office on three separate occasions, including June 17, June 21, and June 29, which is the date of Malinowska's arrest and federal custody.

Malinowska, who is a member of a Portland-based band called "Moth Kit," self-identifies as transgender and changed identity from male to female in May 2023, according to court filings. Many of the apprehended and/or charged ICE occupation suspects so far self-identify as transgender.

David Pearl, 35, of Portland, has been charged with failing to obey a lawful order and creating a disturbance. According to the Justice Department, Pearl rushed in to interfere with the lawful arrest of Malinowska on the evening of June 29. He was subsequently arrested and taken into federal custody.

Trenten Edward Barker, 34, of Portland, has been charged with felony arson of federal property and depredation against federal property. Barker, who identifies as trans nonbinary, has been accused of launching an arson attack on the ICE building, which is adjacent to an elementary school.



According to a federal affidavit, Barker was observed among a group of black clad individuals constructing a barricade against the vehicle gate at the ICE building at approximately 9:50 pm on June 11. "Items used to barricade the vehicle gate consisted of a range of materials, including roadway signs, traffic cones, cardboard, tree branches, logs, assorted pieces of lumber, tables, and electric battery-powered scooters," according to the affidavit.

Barker, wearing all black with a backpack, was observed on ICE building surveillance footage standing in the driveway one minute later, at approximately 9:51 pm. Barker allegedly reached into the backpack and retrieved a flare before lighting it and tossing it onto the pile of materials stacked against the vehicle gate. "The lit flare that Barker threw was used as a heat source to ignite the materials stacked against the vehicle gate," according to the affidavit, which states that a federal agent reported observing growing flames as the fire progressed. Federal agents put out the fire several minutes later after multiple attempts.

At approximately 10:45 pm, officers with the Portland Police Bureau moved into the crowd and apprehended Barker in a targeted arrest. According to the affidavit, Barker initially resisted arrest, but ultimately complied. Damage caused to the vehicle gate by the fire has been estimated to exceed $4,000, per court filings.

August Dean Gordon, 31, of Beaverton, Oregon, was also federally charged with willful depredation of government property and assaulting federal police officers. As The Post Millennial previously reported, Gordon has been accused of physically attacking five federal officers on June 29 when they rushed in to arrest him for allegedly damaging the ICE facility. He allegedly kicked them, violently grabbed their genitals, and left at least one officer bloodied, according to an affidavit.



All four defendants were arraigned on charges Monday in the US District Court in Portland.

More than 20 people have been arrested and charged with alleged offenses committed during Antifa's 24-hour occupation outside the ICE facility. Charges have included assaulting federal police officers, including with a knife, blinding officers with high-powered lasers, violating lawful instructions, and setting fires near the facility after using devices to confine federal agents and people within the ICE office.
