Elderly vet dies from injuries after being shoved onto NYC subway tracks—illegal immigrant charged with murder

An illegal immigrant has been charged with murder after allegedly shoving an 83-year-old veteran onto the New York City subway tracks on the Upper East Side. The veteran and grandfather, Richard Williams, has succumbed to his injuries.

Honduran illegal immigrant Bairon Hernandez, 34, was arrested on March 10 and his charges have been upgraded to murder after the elderly veteran died from his injuries. The veteran had been declared "brain dead," and Williams' daughter, Debbie Williams, told the New York Post the elderly man was likely not going to make it.

The death was ruled a homicide after the incident. The incident took place on March 10 and videos of the incident went viral online. Hernandez was initially charged with attempted murder, attempted assault, assault, and reckless endangerment. However, with the death of Williams, he has been hit with the murder charge.

Hernandez did not say a word during the incident and had never interacted with Williams before the incident. Another man, John Pena, 30, was also shoved onto the tracks by Hernandez the same day. Pena ignored the injuries he had and helped Williams get back up onto the platform just moments before a train arrived at the station.

Cell phone footage from Pena showed the suspect casually strolling along before shoving the men onto the tracks. Hernandez is a "serial criminal" and has a rap sheet with 15 charges. He has been deported four separate times, according to the Department of Homeland Security.

The next court date for Hernandez is March 30.

“Bairon Posada-Herandez is a serial criminal, and four-time deported illegal alien from Honduras who should never have been able to walk our streets and harm innocent Americans,” DHS Deputy Assistant Secretary Lauren Bis said. “We are praying for the victims and their families. DHS is calling upon New York sanctuary politicians to commit to this ICE detainer and not release this heinous criminal back into New York communities.”
