BREAKING: Federal Court issues temporary halt to Biden’s vaccine mandate over 'grave statutory and constitutional' issues

On Saturday, and citing "grave statutory and constitutional issues," the Fifth Circuit of the Federal Court of Appeals has temporarily suspended the federal vaccine mandate.

On Saturday, and citing "grave statutory and constitutional issues," the Fifth Circuit of the Federal Court of Appeals has temporarily suspended the federal vaccine mandate.

The mandate which was formally enacted by the Occupational Safety and Health Administration (OSHA), required companies with more than 100 employees to require them to be vaccinated, or get tested weekly for COVID-19.

The court order states:

"Before the court is the petitioners' emergency motion to stay enforcement of the  Occupational Safety and Health Administration's Nov. 5 2021 Emergency Temporary Standard (the "Mandate"), pending expedited judicial review."

"Because the petitions give cause to believe there are grave statutory and constitutional issues with the Mandate, the Mandate is hereby STAYED pending further action by this court."

The order goes on to mention that the injunction may be made "permanent", as said motion is still pending and before the court:

"The Government shall respond to the petitioners' motion for a permanent injunction by 5pm on Monday Nov 8. The petitioners shall file any reply by 5pm on Tuesday Nov. 9."

The mandate in question was issued on Thursday Nov. 4 2021, and had set a deadline for compliance of Jan. 4 2022.
