Gomez's blood alcohol level was three times the legal limit.
A Honduran illegal immigrant has been arrested in Baldwin County, Alabama following a crash that left his girlfriend's six-year-old daughter in critical condition. Zelvin Gomez, 25, was subsequently charged with driving under the influence and first-degree assault and is being held on $150,000 bond.
Gomez, who remained in the United States illegally after having his asylum application denied, had a blood alcohol level three times the legal limit at the time of the crash. A detainer has been placed on him ensuring he will eventually be turned over to immigration officials.
According to WKRG, the incident took place around 3am on County Road 28 in Summerdale. Gomez had been driving with his girlfriend, their dog, and her daughter. Gomez and his girlfriend got in an argument, which ended in the girlfriend and the dog. He and the 6-year-old girl continued driving, and a short time later he crashed through a fence, flipping the vehicle, ejecting the child, where she was then pinned under the car.
Gomez was later taken into custody, where investigators determined his blood alcohol level had been .22 — nearly threes times the legal limit — and that he had been going 68mph in a 45mph zone at the time of the crash.
First responders managed to free the girl, and she was airlifted to hospital via helicopter where she is in critical condition, per FOX10. Immigrations and Customs Enforcement have placed a hold on him, which will be executed when legal proceedings have concluded.
