The stance of the Biden adminsitration on child sex changes has been hard to completely pin down. In 2022, Joe Biden put out a video on the Transgender Day of Visibility instructing parents to "affirm" their children. "To parents of transgender children: affirm your child's identity," Biden said, "one of the most powerful things you can do to keep them safe and healthy."

In June 2024, the White House came out and said, of child sex changes, "These are deeply personal decisions and we believe these surgeries should be limited to adults." But while they said that, per The New York Times, they were also suing the state of Tennessee for passing a law banning child sex changes. An article appeared in The 19th News saying that the White House supported so-called "gender affirming care" in the form of mental health treatment.

Then, the Human Rights Campaign, an advocacy group dedicated to trans issues, said that Biden's "position on healthcare for the transgender community has not changed," and that White House Domestic Policy Council Neera Tanden said the administration's position was that "families should have the freedom to make the medical decisions that they and their doctors determine are best for them – which is why we oppose attempts to limit healthcare for transgender individuals in the courts or through legislation," according to Advocate.

So where does the administration stand? And where does presumptive Democrat nominee for president, Kamala Harris, stand?

These are questions that members of the House Anti-Woke Caucus want answers to. They issued a letter to Health and Human Services Secretary Xavier Becerra demanding answers. "We write to you today seeking clarity on the Department of Health and Human Services (HHS) and the Biden-Harris administration’s position on gender transition surgeries for children," the letter from Reps. Jim Banks, Claudia Tenney, Josh Brecheen and Jeff Duncan begins.

They cite studies showing that childhood gender dysphoria, the diagnosed condition that starts so many children on the road to drugs and surgeries in service to the lie that one can change sex, usually resolves itself by puberty, meaning that the children desist and determine that they were not born in the wrong bodies after all. The congressmen describe the trouble with the drugs given, such as infertility and a deprivation of sexual function. These practices have been part of the World Professional Association for Transgender Health's prescription for gender dysphoria in youth and it was recently revealed that Becerra's second-in-command, trans pediatrician Dr. Rachel Levine, pushed WPATH to remove age limits for sex changes.

"According to recently unveiled legal filings, Admiral Rachel Levine, Assistant Secretary for Health at HHS and the highest-ranking transgender government official in U.S. history, successfully bullied the World Professional Association for Transgender Health to remove recommended age minimums for minors seeking genital surgeries and mastectomies from its 2021 treatment guidelines," they write.

"Moreover," they continued, "the Biden-Harris administration has repeatedly attacked state campaigns to restrict such treatments for children, with Vice President Harris last year attacking these efforts in Tennessee, Florida, Idaho, and beyond and referring to them as 'extremist.' Under this administration, the Federal Bureau of Investigation and other federal law enforcement agencies have harassed whistleblowing nurses and doctors at their homes for revealing illegal procedures and Medicaid billing of transgender surgeries."

The congressmen stated that they had concerns over the "contradictory statements" made by the Biden administration, and offered questions in an attempt to clarify that position. These are:

1. Why does the Department of Health and Human Services website still support gender transitions on minors, per its “Gender-Affirming Care and Young People” guidance document?

a. Does your agency continue to believe that gender-affirming care for minors should consist of an array of services including medical and surgical services?

2. What prompted the statements reported by the New York Times that the Biden-Harris administration changed its policy on minors accessing gender transition surgeries?

3. Why did the statement in The 19th change? What was wrong with the phrase “like mental health care”?

4. How does the Biden-Harris administration define “continuum of care”?

a. Does this include medical and surgical services, as stated by the document posted by the Department of Health and Human Services?

b. What treatments, other than mental health services, does “continuum of care” include? Specifically, which of the following treatments, if any, can be safe and effective for children suffering from gender dysphoria:

i. Castration
ii. Orchiectomy
iii. Scrotoplasty
iv. Vasectomy
v. Hysterectomy
vi. Oophorectomy
vii. Ovariectomy
viii. Metoidioplasty
ix. Penectomy
x. Phalloplasty
xi. Vaginoplasty
xii. Vaginectomy
xiii. Reduction thyrochondroplasty
xiv. Chondrolaryngoplasty
xv. Mastectomy
xvi. Augmentation mammoplasty
xvii. Vocal modification surgery
xviii. Facial reconstruction surgery
xix. Genital tucking and packing
xx. Chest binding
xxi. Laser hair removal
xxii. Spironolactone
xxiii. Cyproterone acetate
xxiv. GnRH agoniste
xxv. Conjugated estrogens
xxvi. 17-beta estradiol
xxvii. Estradiol valerate or cypionate
xxviii. Estradiol patch

xxxi. Testosterone undecanoate
xxxii. Testosterone 1% gel
xxxiii. Testosterone patch
xxxiv. Leuprolide
xxxv. Triptorelin

5. Should the government play any role in regulating gender transition treatments? If so,
what is it?

6. Was the Human Rights Campaign correct when it asserted that the Biden-Harris
administration’s “position on healthcare for the transgender community has not changed?

The Biden administration has been all in on trans, gender, and LGBTQIA+ issues. During his first days in office, Biden signed executive orders requiring every federal agency to figure out how to better push "inclusivity" for LGBTQIA+ issues. The results have taken many forms.

The Department of Agriculture decided to restrict free school lunch programs in school districts that prevented children from using cross-sex bathrooms if those children claim to be trans. The Department of Education demanded that all schools allow students to use the facilities—from bathrooms to locker rooms–that align with their "gender identity" not biological sex. The Department of Justice has brought suit against states that restrict sex changes for minors. And the Department of Health and Human Services has pressured insurance companies to cover sex changes for minors and adults. Across the board and in regulations, federal agencies have conflated biological sex and gender so that there is no legal difference between a man who says he's a woman and a woman who just is actually a woman.
