The Office of Management and Budget (OMB) wrote in a Statement of Administration Policy that Biden will first extend the Covid national emergency which is scheduled to expire on March 1 and the public health emergency (PHE) which will expire on April 11.
Biden will extend the two emergency orders until May 11 and then they will be allowed to expire.
According to the OMB, "An abrupt end to the emergency declarations would create wide-ranging chaos and uncertainty throughout the health care system — for states, for hospitals and doctors’ offices, and, most importantly, for tens of millions of Americans.”
When the emergencies expire, Title 42, a measure put in place by the Trump administration in March 2020 that enables immigration officials to quickly expel migrants due to public health concerns, would be automatically lifted.
According to the OMB, lifting Title 42 would "result in a substantial additional inflow of migrants at the Southwest border."
Despite the Biden administration’s attempts to lift Title 42, the US Supreme Court temporarily halted Title 42's termination last month and allowed the policy to remain in place until the court hears a challenge from Republican-led states.
Biden’s moves were also in response to Republican plans to bring two resolutions to the House floor later this week calling for an immediate end to the Covid emergencies.
Rep. Paul Gosar (R-AZ) who introduced a bill to end the Covid emergency immediately said the House will go ahead with the vote on Wednesday tweeting, "There is no reason to wait. There is no reason to trust the Biden Regime."
Biden had previously told CBS' "60 Minutes" in September that "The pandemic is over. We still have a problem with COVID. We're still doing a lot of work on it, but the pandemic is over."
