12-year-old Jusiah Jones, 13-year-old Nelson Nunez, and 15-year-old Xavier Tyson have all been charged as adults in the case.
A judge has granted house arrest for a 12-year-old boy for his alleged role in the 2025 violent rape of a 12-year-old girl at a Miami community garden.
Jusiah Jones, 12, was granted house arrest while awaiting trial in a hearing on Monday, while 13-year-old Nelson Nunez was denied bond. Jones, Nunez, and 15-year-old Xavier Tyson have all been charged as adults in the case, per NBC 6.
Police say that the victim informed investigators that she had been taken to the Green Haven Project in the Miami neighborhood on Overtown by the group of boys on June 18, 2025, and was held down by Jones and Tyson. She said she was prevented from screaming when her mouth was stuffed full of rocks. Nunez went on to rape her, police said.
The three boys were indicted by a grand jury on charges that include kidnapping and false imprisonment. Prosecutor Arvind Singh said of Jones’ involvement in the case, "He is the one who actually put the rocks in her mouth to silence her from screaming. His actions allowed Nelson Nunez to continue raping the victim. All 3 defendants only stopped when they heard calls from the father. We have no evidence that Jusiah Jones had any type of harm."
Jones’ attorney claimed that his client had been pressured into participating in the assasult by the other boys. Defense attorney Jean-Michel D'Escoubet said, "The position he was in is that he was forced to do the things that he did by the other two children as a threat of force. And those are the words of the young victim herself."
An attorney for Nunez also sought for his client to be released while awaiting trial, claiming that he was remorseful and admitted to the crime, and that his family was willing to take him home. Defense attorney Bijan Sebastian said, "Disappointed, they are disappointed. He is a young child, he is 13 years old, of course these are serious allegations but he is 13 years old, so of course he was hoping to reunite with his family. The family was hoping to be reunited."
