On Wednesday, Justice Stephen Breyer said that he thinks Justice Clarence Thomas is doing "fine" after Thomas was admitted to the hospital last week with what was diagnosed as an infection.
Thomas was admitted to Sibley Memorial Hospital in Washington, DC on Friday after experiencing "flu-like symptoms."
Nearly a week later, with very little word from the Supreme Court in regards to Thomas's current condition, a reporter caught up with Breyer, who is set to retire at the end of his term, to ask about his colleague.
"How is Clarence Thomas doing these days?" a reporter from TMZ asked as Breyer was walking towards Cafe Milano in Washington, DC.
"I think he's fine," he responded.
The reporter also asked about the ongoing hearings for Judge Ketanji Brown Jackson, who was nominated by President Biden to fill Justice Breyer's position.
"Their politics is not my affair," Breyer replied. "My affair is done."
On Sunday, the Supreme Court released a statement saying that Thomas had undergone tests and was diagnosed with an infection.
"His symptoms are abating," the statement continued, "he is resting comfortably, and he expects to be released from the hospital in a day or two."
Despite expectations that Thomas was to be released from the hospital by Tuesday evening, the Supreme Court has yet to comment on the justice's hospitalization status nearly a week later.
The Supreme Court noted that Thomas has been participating in case proceedings by reviewing the arguments' transcript, audio of oral arguments, and briefs.
