Matthew Ingalls stated he was too intoxicated to consent to sex on night Jane Doe alleges she was gang raped at Cornell

Ingalls, who has not been charged with a crime in the case, was the man who invited Jane Doe to the Chi Phi fraternity house before the incident took place. During Cornell's investigation into the October 19, 2024 incident, Ingalls claimed that he was too intoxicated to consent and that Doe was actually the one who committed assault, per ABC News.

In the days after the incident, Doe remained in contact with some of the men that she later claimed raped her. “I will also say this is f*cking RUINING my life temporarily. My reputation is destroyed and I’m utterly ashamed. I’m f*cking pissed cause this many people shouldn’t know and I feel like I know who some of the rats in the room were,” she wrote to Ingalls in the days following the incident. She had contacted Ingalls as well as two other men that were involved in the incident.

She also recorded phone calls that she later turned over to Cornell during the university's investigation. “If I just know what happened, then I can feel a little bit better and move on and maybe be able to stay at this school,” she said in one of the phone calls to Ingalls.

Doe claimed that she was struggling to finish the semester after the incident and did not understand everything that took place that day. However, Ingalls insisted that Doe had told him that she was sober. "You did tell me you were sober, by the way. You did, you said you hadn’t been anywhere," he said during the phone conversation.

She fired back on the recorded call, "That is not true. I never would have said that." Doe then asked him to recount the night and everything that took place. “So you come in, say hi,” Ingalls told the then-20-year-old fellow student. “We start dancing for like maybe three to five minutes, and then I pop the question." Ingalls had asked her if she wanted to engage in a "threesome."

“You say yes. Then I remember, like, we didn’t know who else to bring, so I go up to [redacted] who was on the dance floor, too, and I pop the question, and he’s like, ‘Yo,’ and then we go upstairs,” he added. Ingalls, however, did not mention in the phone conversation that he allegedly told other fraternity members in a group chat that they could "walk in and whip it out."

The revelations come after Doe has filed a lawsuit claiming that she was gang raped by seven fraternity members that night, including Ingalls. The lawsuit was filed in mid-September this year, but this was after Doe went to university police on November 8, 2024.

Tompkins County District Attorney Matthew Van Houten, who investigated the case, said in a statement once the lawsuit came out earlier last month that Doe's "sworn statement in November of 2024 did not allege that she was drugged against her will or gang raped. On the contrary, Jane Doe’s statement described her participation in drug use and sexual conduct as voluntary, conscious, and consensual."

Van Houten cited a number of statements that indicated that the sex was voluntary from Doe's original sworn statement and that her consent was followed, including that she was "pretty ok" with having a threesome with two of the males, had said "sure" when the males asked to do drugs off of her body, and that Doe had asked them stop the sexual conduct and the conduct stopped.

"While the behavior of certain Chi Phi fraternity members was without question disgusting and morally reprehensible, the foundation of the criminal justice system is that criminal prosecutions must be based upon evidence and not emotion," Van Houten added in his statement.
