A March 2023 New York Times article revealed that President Joe Biden wanted Attorney General Merrick Garland to "stop acting like a ponderous judge and to take decisive action" where it concerned former President Donald Trump, and what Biden believed was a "threat to democracy."
The Times, speaking to Biden's "confidants," found that far from hoping his Department of Justice would be independent, Biden wanted it to prosecute Trump. This article came after Trump was indicted in New York by DA Alvin Bragg on charges of "falsification of business records."
Bragg asked that those 37 federal charges be elevated to felonies, though he has not disclosed what makes them felonies. The only way these could be felonious charges is if there were a secondary crime. Just what that is alleged to be has not been revealed. The charge is that Trump recorded as "legal fees" payments made to his lawyer that in turn were paid to a woman with whom Trump was alleged to have had a dalliance.
Trump has now been indicted on charges by Biden's DOJ, including several charges stemming from documents stored at his Mar-a-Lago residence, which were seized by the FBI in August 2022, as well as conspiracy charges as pertains the aftermath of the 2020 presidential election, which Trump asserts was skewed in Biden's favor.
Biden and his White House have repeatedly said that the DOJ, which is part of the executive branch of the federal government, is independent from the Biden administration. Even as that body has continued to prosecute Biden's main political rival, with whom Biden is polling neck and neck for the 2024 presidential election, Biden has said that the DOJ can be "trusted."
"I have never once, not one single time, suggested to the Justice Department what they should do or not do relative to bringing a charge or not bringing a charge," Biden said in June.
"I'm honest," he said.
Biden has also made persistent and repeated claims that he has not been involved in nor spoken to his son Hunter's foreign business associates, yet one of Hunter's associates, Devon Archer, testified Monday before the House Oversight Committee that not only is this a lie, but that he was personally in attendance during at least 20 meetings in which Joe Biden had been put on speakerphone in an apparent advertisement for the Biden "brand."
