On Wednesday, Justice Stephen Breyer was confronted by a reporter outside Cafe Milano in Washington, DC, being asked about his colleague’s condition.
"I think he's fine," he responded.
While Thomas was absent from the court room this week, he participated "in the consideration and discussion of any cases for which he is not present on the basis of briefs, transcripts, and audio of the oral arguments," the Supreme Court states.
No additional details on Thomas' release from the hospital are currently available.
