“If that person is for some reason not a citizen or was born elsewhere. All of a sudden, they have to face an additional level of scrutiny through ICE.”
Democratic Socialists of America (DSA) member and Democrat candidate for the House of Representatives Darializa Avila Chevalier has claimed that it is a "violation of our Constitution" for ICE to arrest and investigate those not born in the US. She will likely be elected to represent New York's 13th District on November 3.
She made the comments during an interview on WNYC's Who's Running This Place? podcast while discussing immigration issues. "Think about for example the way we deal with folks who are citizens who engage in criminal activity. They go through the criminal system, they are tried, and then they pay their debt to society."
"But if that person is for some reason not a citizen or was born elsewhere. All of a sudden, they have to face an additional level of scrutiny through ICE. That is in itself a violation of our Constitution on the basis of where someone was born," she added.
Leading up to those comments, she claimed that ICE apprehends people simply because "they might look like an immigrant" and that is a "dangerous precedent ... that really undermines public safety." She claimed that ICE undermines public safety and added that ICE creates "chaos" because it is a "rogue agency" that should be "abolished."
Chevalier has previously said that she wants to abolish ICE as an agency and said earlier this month, "We are going to abolish ICE, and we're going to take that to the federal level and do it in Congress.”
The Democrat, who has been backed by socialist New York Mayor Zohran Mamdani as well as the DSA, is more than likely going to win her congressional race in New York's deep blue 13th district. She is running against Manual Williams, the candidate for the Republican Party.
