Prosecutors not pursuing several allegations in Diddy RICO case to streamline charges

Federal prosecutors in the case against Sean “Diddy” Combs have announced they will not pursue several allegations previously tied to the investigation, including attempted kidnapping, attempted arson, and aiding and abetting sex trafficking.

In a letter filed Tuesday and sent to the judge overseeing the case, prosecutors said they aim to simplify the charges and streamline jury instructions. The case has drawn attention due to earlier speculation about potential RICO charges, though prosecutors clarified they are narrowing the scope of the case, not abandoning it. Combs is still charged with sex trafficking and racketeering.

"The Government understands the Court’s desire for streamlined instructions. With that in mind, the Government has suggested ways to streamline those instructions," prosecutors wrote in the letter, according to a report by Fox News.

"Specifically, the Government has removed instructions from the charge relating to (i) attempted kidnapping under both California and New York law, (ii) attempted arson under California law, and (iii) aiding and abetting sex trafficking. The Government is no longer planning to proceed on these theories of liability, so instructions are no longer necessary,” the letter detailed.

Prosecutors emphasized that the case itself is still moving forward, and charges remain active, though now with a narrowed focus. The prosecution and the defense concluded their cases on Tuesday following six weeks of testimony. Combs' team has repeatedly motioned for a mistrial in the case several times. The jury could start deliberating as early as June 30, following closing arguments this week.

Former federal prosecutor Neama Rahmani, the co-founder of West Coast Trial Lawyers, explained to Fox News that "no charges are being dropped."

"The prosecution’s legal theories are essentially the same. The government is no longer pursuing the attempted kidnapping and attempted arson as predicate acts for racketeering. But they can still argue that the completed kidnapping of [Cassie] Ventura and [Capricorn] Clark and completed arson of Kid Cudi’s vehicle are RICO acts. The same applies to the sex trafficking counts. The government is arguing that Combs sex trafficked the victims, not that he aided and abetted others to do so. They’re simplifying the charges for the jury. This doesn’t really change anything."
