Three GOP states suing Biden administration over lifting of Title 42 border policy

The Attorneys General of Missouri, Louisiana, and Arizona have launched legal action against the Biden administration over its plans to end Title 42 provisions allowing for summary deportation of illegal migrants.

The Attorneys General of Missouri, Louisiana and Arizona have launched legal action against the Biden administration over its plans to end Title 42 provisions allowing for summary deportation of illegal migrants.

The lawsuit was originally implemented by the Trump Administration in March 2020 but will now cease to be in effect as of May 23.

According to Fox News, the lawsuit puts forth that the ending of the Title 42 order "was done unlawfully and will have a devastating impact on states." The legal complaint further reads:

"This suit challenges an imminent, man-made, self-inflicted calamity: the abrupt elimination of the only safety valve preventing this administration’s disastrous border policies from devolving into an unmitigated catastrophe."

The Biden administration itself has recognized the potential for a never-before-seen surge of illegal migration on the US's southern border with Mexico, but nonetheless, rescinded the provisions, citing that the COVID emergency is no longer severe enough to justify summary deportations.

Secretary of the Department of Homeland Security Alejandro Mayorkas has told the media, "We are increasing our capacity to process new arrivals, evaluate asylum requests, and quickly remove those who do not qualify for protection."

Mayorkas went on to describe the process: "We will increase personnel and resources as needed and have already redeployed more than 600 law enforcement officers to the border."

"We are referring smugglers and certain border crossers for criminal prosecution. Over the next two months, we are putting in place additional, appropriate COVID-19 protocols, including ramping up our vaccination program."
