The incident occurred earlier this week, according to officials who spoke to the outlet, where Nicol Suarez, 30, allegedly stalked the 14-year-old boy and followed him into a bathroom in Thomas Jefferson Park in East Harlem on Tuesday where the incident occurred.
Witnesses were flagged down by the boy after the attack and then alerted police to the situation. Suarez was arrested on Wednesday and charged with first-degree rape. The illegal immigrant is originally from Columbia and was wanted in New Jersey as well as Massachusetts at the time. Additionally, an immigration detainer had been placed on Suarez, according to law enforcement who spoke to the Post.
“It just goes to show that Donald Trump and [border czar] Tom Homan are correct that you need to get the violent people out of New York City and Eric Adams, Letitia James and Kathy Hochul should all cooperate because this person has an ICE detainer,” a source told the outlet.
"ICE could just pick this person up and deport them back,” the source added. “But due to our sanctuary laws we can’t do anything.”
Judge Elizabeth Shamahs, who became a judge in January after being elected as a Democrat, lowered the bail requested by prosecutors from $500,000 to $100,000 and the bond amount from $1.5 million to $250,000.
“I feel really bad for the kid that has to go through this because his life will never be the same,” the source added. “We worry about the migrants but what about the victim? This is a true victim.”
