A new filing from the defense in the Tyler Robinson murder trial over the killing of Charlie Kirk gives an indication of their strategy. One very technical aspect of their defense will be in trying to discredit Utah County's DNA evidence, getting into details about the way the recovered DNA was interpreted and the expert testimony of the DNA analysts. The filing also reveals that over 1 million Discord communications have been recovered during the investigation along with 25,000 location records and massive amounts of other digital records.
The Post-Preliminary Hearing Status Report Concerning Discovery details the "scale of the discovery" in the case and "the work that must be done by members of the defense team to convert raw discovery productions" into materials the defense team can understand and review. Three categories of discovery were laid out by the legal team.
Those three categories are Documentary, Forensic, and Miscellaneous Digital Evidence, which includes law enforcement and lab reports, forensic materials, body cam and surveillance footage, crime scene photos, search warrants, evidence logs, and other files. The defense details that "25 discovery productions" have been received from the state, including nearly 60,000 files.
Digital Evidence Requiring Specialized Processing and Analysis, which includes "the entire contents of seized devices such as telephones, tablets, computers, external hard drives and other memory devices, native files of stored communications," and affiliated files comprises the second category. The defense team has received "12.1 terabytes of digital forensic data," including 613,023 files and 6,425 folders. The material comes from mobile devices and hard drives. The mobile devices resulted in 2,915,822 "individual artifacts" while the hard drives held 4,887,847 "individual artifacts." An additional 170 gigabytes has not yet been reviewed.
"The Discord return alone contains over 1,000,000 communications," the defense notes, along with "25,253 location records." They argue in the filing that this material takes a great deal of time to organize and review. It is among these communications that evidence surfaced showing Robinson confessing to the killing of Kirk and claiming that Kirk was full of "hate" that could not be "negotiated out."
The third category is for Forensic Discovery, which comprises the DNA reports, analysis, and evidence. During the July Preliminary Hearing, the state presented DNA evidence and expert testimony from DNA analysts. During questioning, the defense team attempted to bring into question the viability of their expertise. The state objected at the time, which the defense team points out in this latest filing, indicating that they seek to question the validity of the interpretation of the DNA evidence.
The defense team states that "in preparation for the extensive reliability hearings that the State alluded to, the defense is in the process of working with its retained experts to prepare expert declarations which will be filed in support of a motion to compel the forensic discovery that the State, through the FBI and the ATF, has refused to provide. That discovery litigation is the necessary step to moving this case forward."
The case is due back in the courtroom of Judge Tony Graf on Tuesday, Sept. 1. Before the court is the decision as to whether or not the prosecution has provided probable cause to try Robinson for the first-degree murder of Charlie Kirk. Kirk was killed while he spoke during an outdoor event at Utah Valley University on Sept. 10, 2025.
Surveillance footage puts Robinson on the roof of the Losee Building opposite Kirk, from which it is believed the fatal shot was fired. DNA evidence also indicates that he was present. His parents saw the surveillance footage released by the FBI following Kirk's killing and recognized their son, encouraging him to work with law enforcement to turn himself in.
If convicted, Robinson could face the death penalty. Kirk leaves behind a wife and two young children along with Turning Point USA, a non-profit he founded that has hundreds of chapters across the US on college and high school campuses.
