"As Governor, I have a responsibility to protect the citizens of Iowa."
On Thursday, the Biden administration filed a lawsuit against Iowa over a new law passed by the state that would use state resources to arrest and deport illegal immigrants.
According to the lawsuit, the Department of Justice (DOJ) claimed that Senate File 2340 attempts to overtake federal immigration law. It states, “The United States brings this action to preserve its exclusive authority under federal law to regulate the entry and removal of noncitizens.”
It went on to claim the law "violates the Supremacy Clause of the United States Constitution.”
In a statement, Reynolds said, "As Governor, I have a responsibility to protect the citizens of Iowa." She added, "Since President Biden refuses to enforce our nation’s immigration laws, threatening the safety of our citizens. Iowa will step in.”
According to WOWT, Iowa Governor Kim Reynalds signed SF2340 into law last month, and it is similar to a Texas law that was recently blocked by the courts.
The ACLU of Iowa claimed in a statement, "This Iowa law conflicts with existing federal law and will have a number of dramatic consequences for Iowans." It continued, " It creates new crimes for anyone in Iowa, including a child, who has reentered the country after being deported, even if that person is now authorized to be in the U.S.”
The DOJ notified Reynolds and state Attorney General Brennda Bird last week they intended to sue unless they agreed by May 7 to not enforce the law. In response, Reynolds said on X, "The only reason we had to pass this law is because the Biden Administration refuses to enforce the laws already on the books."
"I have a duty to protect the citizens of Iowa. Unlike the federal government, we will respect the rule of law and enforce it," she noted.
AG Bird said in a statement, "You know, the border is absolutely out of control, whether it’s trafficking, drugs, crime, even people on the terror watch list." She continued, "In Iowa, we passed a law to do the job the federal government won’t do. And now the Biden Administration, they say they’re gonna sue us.
"Well, I’ve got something to tell the Biden Administration in response: Go pound sand," She added. "You know, maybe instead of going around and suing people who enforce our laws, they should try to secure the border for a day or two, right?"
