BREAKING: $5 million verdict for E Jean Carroll upheld by appeals court after Trump's appeal

"We conclude that Mr. Trump has not demonstrated that the district court erred in any of the challenged rulings. Further, he has not carried his burden to show that any claimed error or combination of claimed errors affected his substantial rights as required to warrant a new trial."

A federal appeals court on Monday upheld a $5 million civil judgment handed to columnist E Jean Carroll against President-elect Donald Trump. The sum was awarded to Carroll in 2023 after a jury found Trump liable for sexual abuse and that he defamed Carroll when she made her allegations public.

In the ruling, the three-judge panel for the US Court of Appeals for the Second Circuit wrote, "We conclude that Mr. Trump has not demonstrated that the district court erred in any of the challenged rulings. Further, he has not carried his burden to show that any claimed error or combination of claimed errors affected his substantial rights as required to warrant a new trial."

Carroll had accused Trump of sexually assaulting her in a department store dressing room in the 1990s. "She did not report the incident to the police, however, or share it publicly for over two decades," the court noted, adding that she "finally decided to share more broadly what Mr. Trump had done to her in 1996" after allegations began to come out against Harvey Weinstein.

The second case Carroll brought forth against Trump, the one being appealed by Trump, went to trial in late April 2023, and in early May, a nine-person jury unanimously found Trump "liable," of battery and "not liable" of rape. The jury also found that Trump had defamed Carroll. Carroll was awarded a total of $5 million: $2 million in compensatory damages and $20,000 in punitive damages in relation to the battery finding, and $2.7 million in compensatory damages and $280,000 in punitive damages for the defamation finding. Trump’s motion for a new trial was denied by a district court on July 19, 2023.

In a separate defamation case brought forth by Carroll, Trump was ordered to pay $83 million.

Trump spokesperson Steven Cheung said in response to the ruling, “The American People have re-elected President Trump with an overwhelming mandate, and they demand an immediate end to the political weaponization of our justice system and a swift dismissal of all of the Witch Hunts, including the Democrat-funded Carroll Hoax, which will continue to be appealed," per NBC News.
