"This case should be tried within a month, not three years — and it should be over with!"
President Trump criticized the judge overseeing the trial of Tyler Robinson on Friday, saying that the trial should be conducted speedily, not years down the line as the parties in the case have requested. His post comes ahead of a Friday hearing in which Judge Tony Graf is expected to set a trial date for the killing of Charlie Kirk.
“The judge in the Charlie Kirk case is doing a terrible job! This case should be tried within a month, not three years — and it should be over with! The judge is desecrating the memory of the Great Charlie Kirk, while taking forever to ask questions that people already know the answer to. The whole Country is mocking him and our ‘Legal’ System. JUSTICE FOR CHARLIE!”
In filings this week, the defense asked for a trial start date of January 31, 2028, while the defense said the aim should be the third quarter of 2029. Erika Kirk, the widow of Charlie Kirk, has issued a motion to enforce her right to a speedy trial. The filing asked the court to reject the defense’s ask, and aim for a trial start date in 2027.
"If the defense's request is granted, the trial would take place more than four years after the defendant's arrest, and more than three years following the week-long preliminary hearing and subsequent decision by the Court that the defendant would stand trial," the filing from Kirk stated.
"Every additional day of delay carried the weight of all that Charlie's murder has taken from his family, especially his two young children who were just three and one years old when their father was murdered and would be seven and give years old by the time a verdict is handed down under the Defense's proposed schedule. What's worse, the defendant's core argument for delay is that there is such an overwhelming amount of evidence—a perverse position that has no legal basis. Utah law requires that the victims' interests receive actual weight in setting trial, and for the reasons laid out here, those interests include a judicial process that is fair, transparent, and without needless delay."
