"Jack Smith can't resist a $5 footlong. That's according to what we see right there. New and exclusive CNN video of the special counsel at Subway," the CNN host said on Tuesday.
According to the host, CNN reporter Evan Perez attempted to ask Smith a question about President Trump's pending-indictment but Smith declined to "respond to the reporters questions about today's big news."
Donald Trump released a statement on Monday announcing that Smith had notified him in a Sunday letter sent that the Biden administration's Department of Justice considers him a "target of the January 6th Grand Jury." Trump explained that this means he will more than likely be "arrested and indicted."
"Deranged Jack Smith, the prosecutor with Joe Biden's DOJ, sent a letter... stating that I am a TARGET of the January 6th Grand Jury investigation, and giving me a very short 4 days to report to the Grand Jury, which almost always means an Arrest and Indictment," Trump wrote.
This will mark the third criminal indictment against former President Trump by Biden's Justice Department, which many consider to be political persecution at the hands of a weaponized DOJ.
Donald Trump is the current frontrunner in the 2024 Republican primary presidential election, and is also leading President Biden in some 2024 presidential polls.
