Harvey Weinstein rape trial ends in mistrial after jury deadlock

The retrial of former Hollywood mogul Harvey Weinstein’s rape case ended with a mistrial on Friday after the jury said they could not reach a unanimous decision. This is the third trial he has faced regarding accusations that he raped actress Jessica Mann in 2013. 

Weinstein has been convicted of other sex crimes and will remain behind bars. A hearing has been set for June 24 to hear whether prosecutors will move forward with a fourth trial in the case. 

A few hours into Friday’s deliberations, the third day of such, jurors sent a note saying they "have concluded that they cannot reach" a unanimous verdict. Judge Curtis Farber instructed to continue deliberating. After more than an hour back behind doors, the jury sent another note with the same message, adding, "We feel that no one is going to change where they stand," per the Associated Press

Weinstein had first been convicted of raping Mann in 2020, however, that verdict was overturned. In 2025, he faced a second trial in the case, in which the jury was deadlocked on the count related to the alleged rape of Mann, the New York Times reports. Mann has accused Weinstein of raping her in a New York hotel room. She told jurors in the latest trial that she had repeatedly said "no" and tried to leave, but gave in when Weinstein blocked her from leaving and grabbed her arm.

Weinstein’s lawyers argued that the incident in question had been consensual, and that Mann had been in a close, supportive relationship with Weinstein before turning on him when news reports regarding Weinstein’s conduct came forward. In February 2017, Mann sent one of her last emails to Weinstein, which read, "I love you, always do. But I hate feeling like a booty call." Weinstein’s attorneys said he helped Mann land a movie audition, as well as a hairstyling job.
