"This sh*t looking real good," Hernandez mentions to his caller. "Now we got a new DA in LA." Hernandez is currently serving a life sentence without the possibility of parole.
"I got court on the 14th, fool, right here in Compton," Hernandez continues.
"So they¿re going to drop a gang of, um, like my gun enhancement, my gang enhancement," he continues, referring to Gascon's new sentencing guidelines, which apparently can be retroactive.
Under the new guidelines, there will be no more "enhancements" which add time to a sentence, such as the extra 10 years for being a proven gang member, or other other "enhancements," such as if a firearm is used in the furtherance of a crime.
Hernandez specifically mentions both cases to his caller, saying, "my gang enhancement is 10 years, fool, for being a gang member. And then the gun in the commission of a crime."
The new guidelines also, in most cases, do not allow for prisoners to be held without the possibility of parole anymore, which, as stated above, is also an apparent factor retroactively in Hernandez's sentence.
"I’m going to get that n*gga's name [tattooed] on my face," said Hernandez enthusiastically to his caller. That's a champ right there. F*ckin' Gascon."
"That's the n*gga right there, bro. He's making historic changes for all of us, fool."
"... They're like 'you're coming home, blood.' My lawyer already told me, 'you're coming home.'"
