BREAKING: Trump’s attorneys file motion saying Biden DOJ’s requested gag order violates First Amendment

The former president's legal team urged the court to swap the DOJ's request for a sweeping order that would essentially restrict all documents produced by the government in favor of one that would only bar those containing "genuinely sensitive" material from being entered into the public record.

In their response, Trump's lawyers argued that restricting all government documents from being protected under the order runs "contrary to established law" and his "First Amendment rights."

They also pointed out that their proposed amendment to the government's order is "consistent with" others entered by the court in cases related to the January 6 riot.

Trump has been charged with four counts related to his alleged involvement in a plot to overthrow the results of the 2020 election, including conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstriction of and attempt to obstruct an official proceeding, and conspiracy against rights.

On Friday, the DOJ petitioned Judge Tanya Chutkan to issue a protective order against Trump effectively preventing him from speaking publicly about the case.

Trump responded on Monday by calling the DOJ's actions "an attempt to take away my FIRST AMENDMENT RIGHTS."

"No, I shouldn't have a protective order placed on me because it would impinge on my right to FREE SPEECH," the former president continued. "Deranged Jack Smith and the Department of Injustice should, however, because they are illegally 'leaking' all over the place."

The DOJ has sought to bar Trump from speaking publicly about his seized documents case as well.

The 31 DOJ documents to be used in the case, they stated, "shall not be disclosed to the public or the news media, or disseminated on any news or social media platform" unless otherwise given permission from the court.
