WATCH: Biden says ending Title 42 is ‘overdue’ despite ongoing border crisis
When asked, “What’s your reaction to Title 42?” Biden responded, “The court is not going to decide until June, apparently, and in the meantime we have to enforce it, but I think it’s overdue.”
President Biden told reporters as he was leaving for his vacation on Tuesday that he believed the ending of Title 42 was "overdue."
He made this statement to reporters who asked about his reaction to the pandemic-era policy that has allowed authorities to quickly and efficiently expel migrants on public health grounds.
"The court is not going to decide until June, apparently," he says, "and in the meantime, we have to enforce it, but I think it's overdue."
The Supreme Court on Tuesday ruled 5-4 in favor of a Republican-led request that Title 42 be allowed to stay in place, as doing otherwise would result in an additional surge of migrants crossing the border illegally.
The decision puts on hold a ruling made by U.S. District Judge Emmet Sullivan last month that blocked its use on the grounds that the policy was "arbitrary and capricious."
Biden has received widespread criticism for his vacation to the Caribbean island of St. Croix at a time when the U.S. border crisis is intensifying, and mere days after a once-in-a-lifetime winter storm has left at least 70 Americans dead and crippled huge swaths of the country.
The President has been eyeing the end of Title 42 since as far back as May, when a federal judge blocked the administration from retiring the policy.
Republicans have reacted positively to the ruling keeping Title 42 in place, as fears grew over the last week that retiring the policy would make the crisis unmanageable, while the Biden administration has repeatedly downplayed the extent of the crisis.
"Every person that you're talking to in the Biden administration does not see this as a problem," Texas Rep. Beth Van Duyne said earlier this week. "When you talk to the President, he just says 'look, there are other problems that we have,'"
The administration has yet to share details as to what policies should replace Title 42 when it expires, despite White House Press Secretary Karine Jean-Pierre saying on December 19 that more information would be shared "tomorrow."
