Uriel Santiago Perez, 38, of Mexico, has a 2013 prostitution conviction in Georgia.
The incident occurred on October 6 while Santiago Perez was touring a home for sale in North Fort Myers. The victim is the homeowner's son, who Santiago Perez allegedly isolated in a bathroom and proceeded to abuse him, the Lee County Sheriff's Office said.
The father told authorities that Santiago Perez had contacted him earlier in the week to arrange a showing of the home. Shortly after Santiago Perez arrived, the victim and the father began a tour of the house. The alleged sexual assault occurred when the father briefly stepped outside for a smoke break.
According to the LCSO, the victim immediately reported the incident to police. When deputies arrived, Santiago Perez had already left. However, the Mexican national had reportedly told the victim to meet him at a certain location outside the home, and officers located Santiago Perez in that spot. He was subsequently taken into custody.
Santiago Perez has been charged with one count of sexual battery on a victim between the ages of 12 and 18, records show. Federal law enforcement sources told Fox News that Santiago Perez has a previous criminal record dating back to at least 2013, when he was convicted of prostitution in Georgia.
ICE first encountered Santiago Perez after a 2015 arrest in Gwinnett County, Georgia. However, Santiago Perez was not taken into ICE custody due to an Obama administration enforcement policy memo issued in 2014 that prevented his federal arrest, a federal source told Fox News.
It's unclear when Santiago Perez entered the United States. ICE has placed an immigration hold.
