Trump will be on trial during Iowa primary if Biden's DOJ gets its way

On Thursday, Special Counsel Jack Smith's prosecutors proposed Jan. 2 for the trial of Donald Trump for allegedly attempting to overturn the 2020 election which could affect the former president’s ability to campaign before the Iowa caucuses which are scheduled for Jan 15.

Federal court filings show that prosecutors from Smith’s office claimed that the proposed date "serves the public’s interest and the interests of justice, while also protecting the defendant’s rights and ability to prepare for trial," according to NBC News.



They wrote, "January 2 trial date would vindicate the public’s strong interest in a speedy trial — an interest guaranteed by the Constitution and federal law in all cases, but of particular significance here, where the defendant, a former president, is charged with conspiring to overturn the legitimate results of the 2020 presidential election, obstruct the certification of the election results, and discount citizens’ legitimate votes."

According to Smith’s prosecutors, the "case in chief will take no longer than four to six weeks."

If US District Judge Tanya Chutkan, an Obama appointee and campaign donor, approves the proposed date, not only could the trial affect Trump’s campaigning for the Jan 15 Iowa caucuses but also campaigning for Nevada, New Hampshire, and South Carolina.

A January trial date could also affect E. Jean Carroll's defamation lawsuit which is scheduled to go to trial on Jan. 15 and two other criminal trials against the former president scheduled from January to May.

John Lauro, Trump’s lawyer, told “The Today Show” last week that Smith's office was looking to go to trial in 70 days, while it has had “3 and a half years” to investigate the case.

In response to the news, Trump wrote on Truth Social, “Deranged Jack Smith has just asked for a trial on the Biden Indictment to take place on January 2nd, just ahead of the important Iowa Caucuses. Only an out of touch lunatic would ask for such a date, ONE DAY into the New Year and maximum Election Interference with Iowa!”



“Such a trial, which should never take place due to my First Amendment Rights and massive BIDEN CORRUPTION should only happen, if at all, AFTER THE ELECTION. The same with other fake Biden Indictments. Election Interference!

Prosecutors said in their filing that they expect "substantially" all of the evidence will have been turned over to Trump’s lawyers by Aug. 28. At that time, the judge will review proposals from both sides and set a trial date.
