The defense team had claimed that because the daughter of one of the attorneys was present at the Utah college campus when Kirk was fatally shot, the team should be disqualified.
Graf said, "Defendant argues that high level prosecutor assigned to this case has a concurrent conflict of interest, and because no efforts were made to screen him, the entire office should be disqualified. Because defendant has not established a factual basis for a finding of conflict of interest or an objective appearance of impropriety rising to constitutional concern, his motion is respectfully denied."
The defense had taken issue with Chad Grunander, the chief deputy at the Utah County Attorney’s Office, whose daughter had traveled to Utah Valley University to attend an event Kirk was holding on campus the day he was shot.
"In sum, this court concludes that there is not a significant risk that Mr. Grunander’s loyalty to daughter has or will materially limit his representation of the state of Utah. Furthermore, defendant has not shown that there is a significant risk that Mr. Grunander’s relationship with daughter has or will impact defendant’s due process rights." This is a breaking story.
